Transactions Affecting Commercial Leases

This is a comprehensive session on some transactions affecting commercial leases, including the two most important ones, options and assignments.

The topics considered include the following:

Options for renewal, considering the main substantive and drafting aspects, including under the Retail Leases Act, with precedents.

Rights of pre-emption; Assignment, including restrictions, consent, conveyancing aspects, precedents; Mortgage over lease and freehold; Surrender.

Session 28

The Workers Compensation Commission: Future Directions

There have been a number of significant developments in the Commission in the last two years which Judge Keating will address. The most significant of these was the transition from a larger number of part time Arbitrators to a smaller number of full time Arbitrators; this will occur from 1st July 2010. Other initiatives include the drafting of a comprehensive practise manual for Arbitrators, the rationalising of the regional sittings and a corporate re-structure. There are some practice issues the judge will discuss, mainly around preparing applications.

Bruce McManamey will address advocacy in the Workers Compensation Commission while Mary Hawkins will focus on dispute prevention and management through the use of resources such as plain language guidelines, the Claims Assistance Service, Complaints Management, Model Litigant Policy and audits of self and specialised insurers and Scheme agents.

Steve Lancken will address Negotiating and Mediating WCC claims, Workplace Injury Damages and Statutory Claims. Lawyers have a range of obligations when engaged in negotiations or ADR processes. Those obligations include duties of "Good Faith" in regard to some mandatory mediation programs, general ethical obligations, duties to the Court and to other members of the profession.

Solving Problems and Disputes When They Arise in Building Construction

This Session will be presented by Christopher Whitelaw, a barrister and an accredited mediator, Howard Ryan, a building consultant, expert witness and Managing Director of Pre-Purchase Inspections Registry NSW and George Zakos, a building consultant, mediator and expert witness.

Using a number of case studies the panel will outline to you a new approach to achieving early resolution of building disputes that can save both owners and builders thousands of dollars and amicably and constructively resolve a dispute within 6 to 8 weeks that might otherwise drag on for 6 to 12 months (or more) in the Consumer Trader and Tenancy Tribunal or in the courts.

This session is a 'must' for lawyers, builders, building consultants or dispute resolvers who have an interest in building disputes and are disillusioned with how disputes are currently managed using the legal process.

Online Legal Research

With Web 2.0 technologies becoming so established online legal research skills should no longer be contained to the old favourite resources. Fabian Horton's course stands out from the rest because he teaches you how to continually update your knowledge of online legal resources, rather than "just showing you a few sites".

You will receive the knowledge, skills and techniques required to be a truly effective online legal researcher. In this full day course each participant will be equipped with a computer, hence numbers are limited.

While the information supplied will take researchers to an advanced level, beginners are well catered for.

Section 1: Online Research Techniques (Updated for Web 2.0) - The face of the Internet is going through fundamental changes. You will be taught the latest searching techniques as well as exploring the wide range of legal data available on the web. Fabian will also explain advanced Boolean techniques and what the "Semantic Web" has install for lawyers.

Section 2: Researching Case Law (World Wide) - You will learn advanced methodologies and techniques required for case law research including: what cases are available online, how to find commentary on cases and the effective searching and noting up of cases.

Section 3: Researching Legislation (World Wide) - This section will continue with the methodologies and techniques required for researching legislation. It includes: key sites for legislation, effective searching techniques for currency information, repeals, interpretative materials and the growing number of point-in-time databases.

Section 4: Researching Secondary Materials (Updated for Web 2.0) - With Web 2.0 sites becoming so prevalent you will learn how to take full advantage of what the technologies have to offer. Fabian will show you highly effective techniques for researching secondary materials using a variety of online search engines, wikis, catalogues and blogs. He will also show you how to find law resources, legal news and other current awareness information.

Fabian Horton is a practicing solicitor and director of ConnectLaw, a company that supplies legal research to the legal profession. Fabian has extensive experience in legal technologies and online legal applications and was previously the Training Officer for the Australasian Legal Information Institute (AustLII).
