Enforcement of Securities with Mortgages -
Formal and Procedural Requirements
This is a comprehensive session on the formal and procedural requirements of
exercising mortgagees' powers of sale over real estate. It covers many of the
legal and practical problems and suggests solutions.
Issues addressed include:
- Alternatives to Mortgagee's Sale (including assignment, sub-mortgage, leasing,
affirmation of mortgage, settlement of disputes, foreclosure, etc.)
- Mortgagee's Power of Sale, including pre-requisites to exercise of power,
acceleration of balance due, service of the notice, waiver of notice.
- The Sale, including content and frequency of advertising, promoting and
marketing property, dealing with offers, solicitors' potential liability,

Liability in Health Care
In this session chaired by Peter Dwyer, Roy Beran will discuss important issues
relevant to the presentation of expert opinion evidence,
Vasantha Stesin will address Part VA of the Commonwealth Trade Practices Act
1989 which in effect, provides strict liability for loss caused by defective
products. This presentation will give an overview of the provisions of Part VA
applied to pharmaceuticals and medical devices and will also consider its use
and usefulness, since the relevant legislation was introduced in 1992.
1st July 2010 is the much heralded date for the Australia-wide roll out of a
National Registration and Accreditation Scheme commencing with ten health care
professions. Find out from Christine Campbell how this new scheme has developed
and what impact it will have on your client's professional practice including,
the additional requirements mandated for registrants in these health care
professions.
Karen Mobbs will address the role of the NSW Health Care Care Complaints
Commission under the national scheme.

Negotiation for Lawyers
Since "Getting to Yes" was first published in the early 1980s it has become the
leading text discussing how to influence others to do a good deal. Originally
the product of research funded to come up with the best way for people to deal
with differences, the book has been translated into many languages and sold many
copies.
The theories detailed in "Getting to Yes" offer a rounded approach to
negotiation and can be used to advantage by litigious and transactional lawyers.
In this session, using the " Elements of Principled Negotiation" described in
"Getting to Yes" and "Beyond Machiavelli" you will learn:
- How to recognise a good deal when it is offered;
- How to use standards of legitimacy to be truly influential;
- Communication skills that smooth negotiation;
- The differences between the Competitive and the Cooperative styles of
negotiation, their benefits and downfalls;
- How to maintain relationships when we negotiate (and why);
- The differences between a "position" and an "interest";
- How to close the deal;
- What are your options if the negotiation fails.
This session will be fast paced and involve interactive discussion and exercises
to demonstrate the lessons that we can take from "Getting to Yes" and the work
of the Harvard Negotiation Project. Skills learned can be used in everyday
negotiations, in mediation, at work and in your personal life.

Online Legal Research
With Web 2.0 technologies becoming so established online legal research skills
should no longer be contained to the old favourite resources. Fabian Horton's
course stands out from the rest because he teaches you how to continually update
your knowledge of online legal resources, rather than "just showing you a few
sites".
You will receive the knowledge, skills and techniques required to be a truly
effective online legal researcher. In this full day course each participant will
be equipped with a computer, hence numbers are limited.

Section 1: Online Research Techniques (Updated for Web 2.0) - The face of the
Internet is going through fundamental changes. You will be taught the latest
searching techniques as well as exploring the wide range of legal data available
on the web. Fabian will also explain advanced Boolean techniques and what the
"Semantic Web" has install for lawyers.
Section 2: Researching Case Law (World Wide) - You will learn advanced
methodologies and techniques required for case law research including: what
cases are available online, how to find commentary on cases and the effective
searching and noting up of cases.
Section 3: Researching Legislation (World Wide) - This section will continue
with the methodologies and techniques required for researching legislation. It
includes: key sites for legislation, effective searching techniques for currency
information, repeals, interpretative materials and the growing number of
point-in-time databases.
Section 4: Researching Secondary Materials (Updated for Web 2.0) - With Web 2.0
sites becoming so prevalent you will learn how to take full advantage of what
the technologies have to offer. Fabian will show you highly effective techniques
for researching secondary materials using a variety of online search engines,
wikis, catalogues and blogs. He will also show you how to find law resources,
legal news and other current awareness information.
Fabian Horton is a practicing solicitor and director of ConnectLaw, a company
that supplies legal research to the legal profession. Fabian has extensive
experience in legal technologies and online legal applications and was
previously the Training Officer for the Australasian Legal Information Institute
(AustLII). He has lectured at UNSW, UTS and La Trobe Universities in legal
research and continues to present seminars on the subject.
